Persecution of LtCol Chessani Continues; Govt Seeks Reconsideration of Appellate Court’s Ruling

OLYMPUS DIGITAL CAMERAANN ARBOR, MI – Yesterday evening, government prosecutors filed a motion with the Navy-Marine Corps Court of Criminal Appeals (NMCCA), asking that the unanimous ruling of a 3-judge panel in favor of LtCol Jeffery Chessani, USMC, be reconsidered by all 9 judges of the court.  A majority of these 9 judges would have to agree to take the case.

On March 17, 2009, the 3-judge panel of NMCCA unanimously vindicated the ruling by Colonel Steven A. Folsom, USMC, dismissing all charges against LtCol Chessani on the grounds of Unlawful Command Influence.  LtCol Chessani is the senior-most officer criminally charged as a result of the much-publicized and ill-described “Haditha massacre.”

Richard Thompson, President and Chief Counsel of the Thomas More Law Center, commented, “The way our government has treated this true American hero is outrageous.  After spending over 20 years in loyal service to his nation and considered one of the best combat officers in Iraq, the government is giving Jeffrey Chessani less legal consideration than it is giving the terrorists held at Guantanamo.”

In dismissing the charges against LtCol Chessani, Col Folsom described Unlawful Command Influence as the “the mortal enemy of military justice.”  But despite the solid legal basis for the ruling, the government appealed the decision to NMCCA.  NMCCA heard oral arguments on the government’s appeal on October 17, 2008.

In seeking a reconsideration by the entire panel of NMCCA, government prosecutors now argue that the 3-judge panel misunderstood the difference between an officer’s rank and his billet (job).  Essentially, the government argues that a full colonel in the Marine Corps could not unlawfully influence a Lieutenant Colonel if they held similar billet (job) positions.

The Law Center has a week to file a response to the government’s motion for reconsideration.

If the NMCCA does grant the government’s motion, the government then has 60 days to appeal to the Court of Appeals for the Armed Forces (CAAF) and then even to the U.S. Supreme Court.

Napolitano is Lying to Americans About Her Department’s Rightwing Extremism Report; TMLC Files Suit

imag291ANN ARBOR, MI – The Thomas More Law Center, a national public interest law firm based in Ann Arbor, Michigan, announced that on Thursday, April 16th, it filed a federal lawsuit against Homeland Security Secretary Janet Napolitano.  The lawsuit claims that her Department’s “Rightwing Extremism Policy,” as reflected in the recently publicized Intelligence Assessment, “Rightwing Extremism: Current Economic and Political Climate Fueling Resurgence in Radicalization and Recruitment,” violates the civil liberties of combat veterans as well as American citizens by targeting them for disfavored treatment on account of their political beliefs.   Click here to read the complaint filed by the Thomas More Law Center.

Napolitano tried to blunt the public furor over the Report by a half-hearted apology to veterans, but she left out of her apology all of the other Americans her Department has targeted because of their political beliefs. In fact, officials in DHS now admit that their internal office of civil liberties objected to the language in the extremism report, but the Department issued it anyway.

Richard Thompson, President and Chief Counsel of the Law Center stated, “Janet Napolitano is lying to the American people when she says the Report is not based on ideology or political beliefs. In fact, her report would have the admiration of the Gestapo and any current or past dictator in the way it targets political opponents.  This incompetently written intelligence assessment, which directs law enforcement officials across the country to target and report on American citizens who have the political beliefs mentioned in the report, will be used as a tool to stifle political opposition and opinions.  It will give a pretext for opponents of those Americans to report them to police as rightwing extremists and terrorists.  You can imagine what happens then.”

The Report specifically mentions the following political beliefs that law enforcement should use to determine whether someone is a “rightwing extremist”:

  • Opposes abortion
  • Opposes restrictions on firearms
  • Opposes lax immigration
  • Opposes the policies of President Obama regarding immigration, citizenship, and the expansion of social programs
  • Opposes continuation of free trade agreements
  • Opposes same-sex marriage
  • Has paranoia of foreign regimes
  • Fear of Communist regimes
  • Opposes one world government
  • Bemoans the decline of U.S. stature in the world.
  • Upset with loss of U.S. manufacturing jobs to China and India
  • . . . and the list goes on

The lawsuit was filed in the U.S. District Court for the Eastern District of Michigan on behalf of nationally syndicated conservative radio talk show host, Michael Savage, Gregg Cunningham (President of the pro-life organization Center for Bio-Ethical Reform, Inc (CBR)), and Iraqi War Marine veteran Kevin Murray.  The Law Center claims that Napolitano’s Department (DHS) has violated the First and Fifth Amendment Constitutional rights of these three plaintiffs by attempting to chill their free speech, expressive association, and equal protection rights.  The lawsuit further claims that the Department of Homeland Security encourages law enforcement officers throughout the nation to target and report citizens to federal officials as suspicious rightwing extremists and potential terrorists because of their political beliefs.

Thompson added, “The Obama Administration has declared war on American patriots and our Constitution.  The Report even admits that the Department has no specific information on any plans of violence by so-called ‘rightwing extremists.’  Rather, what they do have is the expression of political opinions by certain individuals and organizations that oppose the Obama administration’s policies, and this expression is protected speech under the First Amendment.”

The Law Center is asking the court to declare that the DHS policy violates the First and Fifth Amendments, to permanently enjoin the Policy and its application to the plaintiffs’ speech and other activities, and to award the plaintiffs their reasonable attorney’s fees and costs for having to bring the lawsuit.

TMLC Demands Dept. of Homeland Security Reveal Basis for its Report Targeting Right Wing Extremists

imag291ANN ARBOR, MI – The Thomas More Law Center announced today that is has filed a Freedom of Information Act request with the Department of Homeland Security demanding to know the basis for their recent intelligence assessment targeting as “rightwing extremists” those who oppose abortion, gun control, lax immigration laws, and a myriad of other policies supported by President Obama’s administration.  The Law Center filed its request after consultation with conservative talk show host Michael Savage.

The Department of Homeland Security’s document in question, “Rightwing Extremism: Current Economic and Political Climate Fueling Resurgence in Radicalization and Recruitment” was released to law enforcement agencies throughout the country.  Of particular concern was the report’s singling out of military veterans as vulnerable to rightwing extremism.

Richard Thompson, President and Chief Counsel of the Thomas More Law Center stated, “This is not an intelligence report but a diatribe against those who oppose the policies of the Obama administration.  It is a declaration of war against the American people and our constitution.  It is a prelude to extreme gun control legislation and hate speech laws targeting Christian churches and others who oppose abortion and same sex marriage.  The federal government should be focusing its attention on the 35 radical Muslim compounds in the U.S. training its followers on how to kidnap and kill Americans.”

Thompson went on to say that this may be another opportunity for the Law Center to team up with Dr. Michael Savage.  Michael Savage, the nationally syndicated conservative radio talk show host of The Savage Nation, recently teamed with the Thomas More Law Center in order to protect free speech by opposing the so-called “Fairness Doctrine.”  Michael Savage warned of the possibility of a document like this being produced by DHS when he raised the issue of “Fusion Cells.”  Fusion Cells are a set of local intelligence centers across the country created by the Department of Homeland Security to combat terrorism and related criminal activity, which includes pro-life activity.

Michael Savage is a longtime on-air supporter of the Thomas More Law Center.  He used his radio show to marshal overwhelming support for one of the Law Center’s clients, Marine LtCol Jeffrey Chessani.  Chessani is being prosecuted by the government in the so-called Haditha massacre – a massacre that never happened.  A military judge ultimately dismissed the case.  The government appealed the ruling and lost, but may appeal again.

TMLC Sues AIG for Promoting Islam; Responds to Justice Dept’s Motion to Dismiss Suit Challenging AIG

imag289ANN ARBOR, MI – The Thomas More Law Center, a national, public interest law firm based in Ann Arbor, Michigan, responded yesterday to a motion to dismiss its federal lawsuit challenging the AIG bailout.  The request to dismiss was filed by the Obama administration’s Department of Justice on behalf of Treasury Secretary Timothy Geithner and the Federal Reserve Board.

Richard Thompson, President and Chief Counsel of the Thomas More Law Center, commented, “Although widespread public anger has rightfully focused on bonuses AIG paid to top executives using taxpayers’ money, that anger would be at an even higher pitch if the public knew that our tax dollars were being used by AIG to promote Islam and Shariah law, which provides support for terrorist activities aimed at killing Americans and destroying America.”

In its motion to dismiss, the Department of Justice claimed that the government does not control AIG and that it provided billions of dollars in taxpayer money to AIG “to address what is possibly the worst financial crisis this country has encountered since the Great Depression.”  In its response the Law Center pointed out that, while our federal government may be compelled to act in unprecedented ways during these difficult times, the crisis itself does not excuse the government from using tax dollars to promote the religion of Islam in violation of the Constitution.  [See the Law Center’s response here.]

The lawsuit, which was filed in December of last year in the U.S. District Court for the Eastern District of Michigan, is a constitutional challenge to that portion of the “Emergency Economic Stabilization Act of 2008” that appropriated $40 billion in taxpayer money to fund and financially support the federal government’s majority ownership interest in AIG, which engages in Shariah-based Islamic religious activities that are anti-American, anti-Christian, anti-Jewish.  According to the lawsuit, “The use of these taxpayer funds to approve, promote, endorse, support, and fund these Shariah-based Islamic religious activities violates the Establishment Clause of the First Amendment to the United States Constitution.”  [See the complaint here.]

Continued Thompson, “Through this taxpayer-funded bailout, our own government is providing financial support to anti-American, Islamic activities.  Make no mistake, there is a cultural jihad underway against our great nation, and I fear that our government is unwittingly complicit in it.”

The lawsuit was brought on behalf of Kevin Murray, a former Marine who served honorably in harm’s way in Iraq to defend our country against Islamic terrorists.  Murray objects to being forced as a taxpayer to contribute to the propagation of Islamic beliefs and practices predicated upon Shariah law, which is hostile to his Christian religion.  He is being represented by Law Center attorney Robert Muise and by David Yerushalmi, an associated attorney who is an expert in Shariah law and Shariah-compliant financing, as well as general counsel to the Center for Security Policy.

According to the lawsuit, through the use of taxpayer funds, the federal government acquired a majority ownership interest (nearly 80%) in AIG, and as part of the bailout, Congress appropriated and expended an additional $40 billion of taxpayer money to fund and financially support AIG and its financial activities.  AIG, which is now a government owned company, engages in Shariah-compliant financing which subjects certain financial activities, including investments, to the dictates of Islamic law and the Islamic religion.  This specifically includes any profits or interest obtained through such financial activities.  AIG itself describes “Sharia” as “Islamic law based on the Quran and the teachings of the Prophet [Mohammed].”

As alleged in the lawsuit, with the aid of taxpayer funds provided by Congress, AIG employs a “Shariah Supervisory Committee,” which is comprised of the following members: Sheikh Nizam Yaquby from Bahrain, Dr. Mohammed Ali Elgari from Saudi Arabia, and Dr. Muhammed Imran Ashraf Usmani from Pakistan.  Dr. Usmani is the son, student, and dedicated disciple of Mufti Taqi Usmani, who is the leading Shariah authority for Shariah-compliant finance in the world and the author of a book translated into English in 1999 that includes an entire chapter dedicated to explaining why a Western Muslim must engage in violent jihad against his own country or government.  According to AIG, the role of its Shariah authority “is to review our operations, supervise its development of Islamic products, and determine Shariah compliance of these products and our investments.”

As further alleged in the lawsuit, an important element of Shariah-compliant financing is a form of obligatory charitable contribution called zakat, which is a religious tax for assisting those that “struggle [jihad] for Allah.”  The amount of this tax is between 2.5% and 20%, depending upon the source of the wealth.  The zakat religious tax is used to financially support Islamic “charities,” some of which have ties to terrorist organizations that are hostile to the United States and all other “infidels,” which includes Christians and Jews.

The Holy Land Foundation for Relief and Development, an example of an Islamic “charity” that qualifies for receipt of the zakat, was recently convicted by a federal jury for providing millions of dollars to Islamic terrorist organizations.  As a direct consequence of the taxpayer funds appropriated and expended to purchase and financially support AIG, the federal government is now the owner of a corporation engaged in the business of collecting religious taxes to fund interests adverse to the United States, Christians, Jews, and all other “infidels” under Islamic law.

Thompson observed, “This lawsuit is as much about protecting constitutional principles as it is about protecting our national security and preventing another 9/11, whether overtly through direct attacks or covertly through a taxpayer funded stealth jihad.”
